Educational Aims

The module aims to facilitate the understanding of the nature and function of industrial property rights and the law relating to them, with particular reference to patents, trademarks, the law of confidence and the law of passing-off. As these are multiple and complex legal regimes with a technological and economic impact case studies will be used in addition to traditional lectures to achieve this understanding.

Learning Outcomes

Students will develop an understanding and in-depth knowledge of the nature and function of industrial property rights and the law relating to them, both in a domestic, an EU and an international context.

Students will develop the intellectual skills to analyse problems in relation to immaterial rights, their social and economic background and their operation in a modern society.

Students will develop the professional practical skills to analyse problems in this area and to address the legal issues raised by them. This includes the examination of patent and trade mark applications, as well as infringement issues. Strategies for clients and their development are also part of this.

In terms of transferable skills the module emphasises the critical examination of the nature and purpose of legal rules in a particular context, and the legal techniques of analysis and critique, the interpretation of primary sources of law and the application of legal knowledge and skills to practical problems.
